Please note, if the child is between 11 and 14, he or she may choose to speak with the judge and voice their choice regarding the parent with whom they wish to reside. The judge may take this choice under advisement, but is under no obligation to follow it. If the child is older than 14, they have the right to make an election, and the judge will give this preference strong consideration. However, the overriding concern of the judge when considering child custody modification is always what is in the best interests of the child. In certain cases, the court will appoint a Guardian Ad Litem (GAL) to represent the child and their best interests. The GAL is a neutral third party who reports back to the judge about circumstances at home and school after speaking with teachers, therapists, physicians, psychologists and other parties. The role of the GAL is to provide the judge with information to help them make a final determination regarding a proposed modification of child custody or visitation.
