What Is a Guardian Ad Litem?

In custody cases, the courts will often appoint a third attorney to act as a guardian ad litem for the children. This lawyer does not represent the children as a client, but represents the best interests of the children when the court is determining custody, visitation and parenting plans.

The guardian ad litem will:

  • Investigate the full circumstances of the divorce and each parent's relationship with their children
  • Interview teachers, physicians and psychologists
  • Conduct psychological evaluations and custodial evaluations (when necessary) to help the courts determine which parent is better suited for custody
