What Is a Guardian ad Litem?
In custody cases, the courts will often appoint a third attorney to act as a Guardian ad Litem for the children. This lawyer does not represent the children as a client, but represents the best interests of the children when the court is determining custody, visitation and parenting plans. The Guardian ad Litem will investigate the situation, interview teachers, physicians, psychologists and conduct psychological evaluations and custodial evaluations (when necessary) to help the courts determine which parent is better suited for custody.
